Våldtäktens skepnader: en kvalitativ studie angående rättsväsendets och ungdomars tolkning av samtycke, sex och våldtäkt

Sammanfattning: It’s difficult to establish the correct definition of what constitutes rape and sexual consent, especially since the definitions are different depending on the source. The different guises of rape are many and will be established as a part of the essay. The differences between how adolescents and the judiciary interpret sexual consent, sex and rape will also be stated. Sexual violence is a major problem due to the amount of women that are assulted each day. The home is the most common place for abuse and assault towards women and the perpetrator is most often her partner. In many cases the women themselves don’t even know that they’ve been raped or sexually assulted, they belive that’s a part of being in a relationship. There’s also a problem with the judiciary in Sweden whereas they can’t handle the sexual and physical violence against women. Instead the women are accountable for their actions before and during the assault and not the perpertrators. Two types of qualitative method where used to obtain the data used in the analysis. Semi-structured interviwes were used when three professionals and nine adolescents were interviwed. The professionals where interviewed to confirm the chosen definition of rape. Qualitative document analysis was used to analyze three court cases where the perpetrators where acquitted. The gender system will be used as a tool to explain and analyze the opinions of the adolescents and the courts declaractions regarding the acuitted verdicts.
