Sammanfattning: The new public procurement legislation that enter force in January 2017, will to a greater extent focus on protecting public interests. This essay addresses the possibility for contracting authorities to consider animal welfare and environmental considerations in public food procurement. Public procurement of food is particularly interesting to examine based on this new legislation. Food procurement largely covers the protection of public interests that has an enhanced space within the procurement law. Particularly the issues of environment and animal welfare. With a recent Finnish decision in principle, food procurement has become a more acclaimed question. What makes it important in bringing this decision into the essay is its relationship to the fundamental EU law principles of public procurement. Particularly due to the fact that the Finnish government through this decision is interpreting the regulation in a way that from a Swedish point of view is contrary to the principles of public procurement. By describing the preparatory work and enquiry leading up to the new procurement law, I intend to shed light on the conditions that contracting authorities enjoy, for enhanced animal protection and environmental considerations procurement. Finally, the essay intends to provide the reader with an enhanced understanding of the importance of procurement contracts that value the protection of public interests. Furthermore, it is my intention and wish that this essay may contribute to the work on sustainable procurement and ultimately sustainable development.
