   Sammanfattning : I den svenska processrätten finns centrala regler som stadgar att domstolar ska verka för att de tvistande parterna, i de fall det är lämpligt, uppnår en samförståndslösning. För att en domstol ska avgöra om det är lämpligt att förordna ett alternativt tvistlösningsförfarande, behöver de under förberedelsen av målet undersöka om det är lämpligt i det specifika fallet att förordna en annan tvistlösningsmetod än en klassisk rättegång.
