(O)lika inför lagen - en diskursanalytisk studie av rekvisitet "annat socialt nedbrytande beteende" i LVU-domar

Sammanfattning: This study aims to investigate judicial decisions of people between the ages of 13-18 years old who have been placed in compulsory care according to the prerequisite “other socially destructive behavior”. A prerequisite that has been criticized for being far too open for interpretation. This study is based on 28 judgments from the administrative court of appeal (Kammarrätten) in 2019, involving 16 boys and 12 girls who in terms of the law were categorized as having “other socially destructive behavior”. The purpose of this paper is to examine how the social welfare committee and the court describes the youths and how the descriptions differ depending on gender. To analyze the judgments we used discourse theory, Yvonne Hirdman’s gender system theory, and Judith Butler’s performativity theory. The main results of this study show that the description of the girls’ “other socially destructive behaviour” tended to focus on mental health issues and sexual behaviour, while the description of the boys mainly focused on problems linked to criminality and violent behavior.
