Sammanfattning: The use of private military and security companies (PMSC) is a growing part of the new wars. They lack accountability compared to state military. The aim of the paper is to examine how accountability affects the degree of which the behaviour of the military actors is aligned with just war theory in Iraq and Afghanistan. Our object of the study is state military and PMSCs who's behaviour we compare to illustrate differences and resemblances. The International Humanitarian Law (IHL) is used, to indicate if their acts are in accordance with the just war theory. The comparative analysis first appraises the military actors' methods and means and second their civilian casualties. We find that poorer accountability of the military actors results in a lesser degree of just war. Therefore, to ensure just war, it is important that the military actors can be held accountable for their acts.
