Sammanfattning: The essay studies the problem between text and data mining (TDM) and copyrighted works. Through technological development, TDM is used, among other things, to make automated decisions in the authorities and in the fashion industry as tools that find similarities between different garments. TDM is used in these fields because it can identify connections and structures in large volumes of data. The process for TDM also includes that the data gets copied. If this data contains copyrighted works, it can infringes the author's exclusive rights and constitutes copyright infringement. The essay investigates the exceptions and limitations that can be applied when TDM is used, for example, in government decisions and in fashion. Chapter 2 of the essay starts with explaining the process of TDM. The following chapter then explains the exceptions that are given in the Swedish Copyright Act (URL) and the exceptions in the DSM-directive. Then the essay continues with a deeper analysis of TDM with two examples of the use within government decisions and fashion algorithms. The essay concludes with a summary and final analysis that clarify when copyright infringement can occur when using TDM. Therefore is the conclusion that copyright infringement occurs if none of the exceptions can be applied for the use of TDM. The possible exceptions can be either the ones i URL regarding for example private use, article 3 and 4 in DSM directive or as a final if the use has the right holder’s permission.
