Detta är en Kandidat-uppsats från Lunds universitet/Institutionen för handelsrätt

Sammanfattning: The relationship between copyright law and the technical advancement of today can be questioned when non-human actors has begun to generate artistically recognized works. The new actors are regarded to as the artificially intelligent robots, machines and computers. This relationship has caused a gray zone to appear in the current legislations, where these rules can be considered inconsequent regarding the rights and obligations concerning artificial intelligence. The first part of the thesis is devoted to examining if an artistic product created by artificial intelligence can be eligible for copyright protection. This question poses further questions regarding to whom the copyright should be allocated, should the work be eligible for copyright protection. Furthermore, the thesis also touches upon the issue of copyright infringement from an artificial intelligence perspective regarding the liability. In conclusion, the thesis determines that the current legislation lacks a complete coverage of situations where artificial intelligence is involved in the creation process, especially when fully autonomous machines are performing the actions.
