Sammanfattning: This essay researches the change in law in regards to the usage of electronic surveillance in combination with a restraining order. The main focus of the essay has been the right to freedom of movement. The essay considers the right to freedom of movement as a special interest to victims of crime. The study explains aspects in regards to criminal law in general and specifically in regards to restraining orders. The essay uses terms such as protected object and both the Swedish constitution, regeringsformen, and the European Convention on Human Rights to nuance the meaning of right to freedom of movement in regards to restraining orders. The essay further inspects the change in law with the prior change in law, both in regards to the usage of electronic surveillance in combination with a restraining order. The findings of the essay conclude that the change of law provides no wide span changes in terms of the consideration of the crime victim’s right to freedom of movement. Therefore, the same critique that was presented to the prior change of law still stands.
