Djurskyddslag i djurens eller människans intresse? - En analys av förslag till ny djurskyddslag
Sammanfattning: In 2011, a report was handed to the government of that time with a proposal for a new law on animal protection, but still, six years later, only a few reforms have been passed. The purpose of this essay is to examine what perspectives on animal rights have formed the law-making process to several suggestions on reforms of the law on animal protection. To guide me in this work I will try to answer several questions concerning the definition of animals and what interests are considered worth protecting in this law-making process. I will also analyze if there are any contradictions that stand out and see if anything is assumed or not problematized. The animal rights perspectives that will form the basis for the analysis represents the three main branches of the field, namely speciesism, utilitarianism and rights based ethics. The analyses reveal an ambition to strengthen the protection of animals in accordance with rights based ethics where the welfare of animals is the focus instead of animal suffering. This is especially noticeable in the matter of ban on sexual actions with animals. This ambition is however in many other areas limited by an approach that is based on speciesism and utilitarianism where the interests of humans is considered superior to the interests of animals and animal suffering is allowed within certain limitations. The human right to use animals as food and objects in experimentations is left unproblematized and there are several contradictions in the matter of animal suffering. The conclusion is that although an ambition to strengthen the protection of animals can be detected the fact remains that the law on animal rights first and foremost is meant to protect animals within human practice. The law is not meant to supply full protection for all animals which results in a main presence of speciesism and utilitarianism.
