Våtmarker – ur ett miljörättsligt perspektiv: En studie av tillståndsprocess, nytta och värdering

Sammanfattning: Wetlands are natural ecosystems that are valuable in many aspects since they offer multiple benefits. According to the Environmental Code wetlands larger than 5 ha are licensed water activities. As the authorization process can be both time and resource consuming this study aims to study the process and try to identify where there may be gaps or obstacles. Since wetlands are valuable ecosystems, it is important that the process is clear and efficient. Therefore, it is interesting to see how the value of wetlands is taken into consideration in the process and the decision making by identifying what may affect whether permission is given or not. In this study literature regarding the authorization process and value of wetlands were studied, then a figure of the authorization process was created. Through interviews with a consultant and the provincial government, details from two important parties of the process were obtained. By using the details the initial question could then be answered. After interviews and discussions, it is clear that the problems that can arise during the process is the fact that the process is both time and resource consuming whilst the information concerning the process are a bit inadequate. Also, technical conditions are required to solve the problems of conflicting interests, such as protected species in the area. Permission will never be announced without the support of the Environmental Code. It is also required that the wetland prove to have a greater value than the costs that may arise or that the operator has the right to use the water provided to the activity. In summary, it should be mentioned that further studies are needed but also, without benefits, technology and legislation a wetland can not be constructed. It is therefore important to have knowledge about the three aspects during the application.
