Sammanfattning: There have been several occurrences where the Building committee has not granted a building permit due to the fact that a real property unit contains partly development district and partly public space. Such a real property unit has been regarded as not corresponding with the detailed development plan. Consequently, the Building committee has referred the person who applied for the building permit to the cadastral authority. If there for a detailed development plan with a private principal is a real property unit which is intruding on public space, should this not restrain the granting of a building permit because of the opportunity to acquire the public space by applying the Joint Facilities Act. This is declared by Didón et al. in the commentary to the Building and Planning Act. Comparatively, it is expressed in the handbook of the Real Property Formation Act that in case of a private principal, the boundary between the development district and public space is not as significant as when the municipality is the principal. The examination of a real property unit´s, which contains partly development district and partly public space, correspondence with a detailed development plan is assessed differently. The aim of this Degree Project in Real Estate Science is to elucidate and examine these differed opinions.
