Den fria rörligheten för varor i relation till det svenska alkoholmonopolet - Systembolagets framtid om gårdsförsäljning blir tillåtet

Detta är en Kandidat-uppsats från Lunds universitet/Institutionen för handelsrätt

Sammanfattning: This paper deals with the free movement of goods in relation to the Swedish alcohol monopoly. Furthermore, the focus is on Systembolaget and its future if farm sales of alcoholic beverages is allowed in Sweden. The provisions relevant to the essay's examination are Articles 34, 36 and 37 TFEU. The questions that the paper thus aims to answer are firstly how articles 34 and 37 relate to each other in relation to the Swedish alcohol monopoly and secondly what the effect of the farm sale could be on the Swedish alcohol monopoly if it is allowed in Sweden. The conclusions that could be drawn after the investigation was made, among other things, that the boundary between articles 34 and 37 is not entirely clear. The articles may be applied differently depending on whether it is justified on the basis of an obstacle to the free movement of goods under Article 34 or the functioning of the retail monopoly under Article 37. Regarding farm sales of alcoholic beverages, this is considered to be fully possible but there are debates, however, as to whether Systembolaget and its alcohol monopoly will remain or not. Any clearer conclusion about this cannot therefore be made until after the next public enquiry of farm sales in 2020.
