Självbestämmanderätten inom LVM-vården - En studie om LVM-lagstiftningens framställning och behandlares tolkning av självbestämmande

Sammanfattning: Abstract Author: Yasar Jaber Title: Self-determination in LVM-care - a study about the laws definition and the care providers` interpretation of self-determination. Supervisor: Jan Magnusson The purpose of this study is to find out how self-determination is defined in LVM-law and how it is interpreted by the care providers in LVM-health and rehabilitation clinic. The used method is qualitative method, semi-structured interviews with two care providers from an LVM-health and rehabilitation clinic and document analysis of preparatory work which consists of legislative proposal, plea and recommendations from Socialstyrelsen. Top-down perspective and symbolic politics are used as theoretic bases to answer the study questions. The result of the study shows that self-determination does not have the same meaning as it appears to. The LVM-legislation highlights a definition of self-determination as an approach for the care providers without further explanation of or restriction in the self-determination. However, there is another definition of self-determination with some restrictions; self-determination must not involve further drug-abuse, distraction of the environment of the LVM-health and rehabilitation clinic and is even described as illusory. Instead self-determination is described as synonymous with motivation. This definition of self-determination is not highlighted in the law, but rather masquerade. The study shows that the care providers interpret self-determination in a similar way and in accordance with the law. Care providers interpret self-determination even as clients´ possibility to choose everyday activities. The difference between the care providers is in the way they look at self-determination in which one sees self-determination only as instrumental, and the other care provider sees even the symbolic dimension of it.
