Missbruk under graviditet- en kvalitativ studie av gravida kvinnors LVM-domar

Sammanfattning: The aim of this study was to examine convictions regarding the Care of Abusers act in the Swedish administrative court. The focus has been on judgements where female substance abusers have been pregnant at the time of conviction. The study has audited, through the courts convictions, what the social services, the administrative courts and the female client has argued about the pregnancy. We have audited 28 different judgements in this study, and a total of eight different categories was found to analyze. These categories have been used to enable a further understanding of the pregnancies relevance in the judgement and the societies view of substance abuse during pregnancy. Our conclusion is that the three different parties have a different approach when mentioning the pregnancy and when they connect it to an argument regarding the womens need of care. The social services have in greater extent a a will to protect the fetus from future consequences of the womans substance abuse. The administrative court was shown to be more apprehensive in their mentioning of the fetus and for the most part referred to that the Care of abusers act can´t be used to protect the fetus from substance abuse related damages during pregnancy. The female referred to her pregnancy as something positive and for the most part she stated in the judgements that she was more motivated to stay sober and therefor saw no need to be convicted to compulsory care.
