Den destruktiva kvinnan och mannen som riskerar att avlida : En kvalitativ textanalys om hur missbrukande kvinnor och män framställs i rättstillämpningen av LVM

Sammanfattning: The purpose of the essay is to investigate how legal certainty is for abusive women and men. This is done by analyzing how the Administrative Court in Stockholm describes women and men in the appealing court decision regarding the preparation of care according to Care of Abusers Act (LVM). The empirical material consists of 20 judicial decisions from the Administrative Court. In order to reach a deeper understanding of the role of gender norms in the judiciary, the survey has been conducted with a gender perspective based on the purpose of the paper, we have considered questions about how women and men are described and whether there are any gender differences in the appealing court decision. To answer the questions, a text analysis based on a hermeneutic approach has been made, then linking the analyzed text in relation to previous research and the chosen theoretical concepts: social construction, stigma and gender. The general conclusions we have reached are that the gender differences described in the court coincide with the general gender norms in the society by describing the gender in various ways in the law application of LVM. This means that the Administrative Court does not fully consider everyone's resemblance to the law according to the principle of equality and objectivity in Instrument of Government (RF). The conclusions are explained by describing how gender is made in a construction process.
