    Sammanfattning : Den traditionella retributiva rättvisan hävdar att rättvisa uppnås när den gärningsperson som har brutit mot lagen bestraffas. Denna process äger vanligtvis rum genom en rättegång där staten först bedömer om gärningspersonen är skyldig till brott och därefter utdömer en straffpåföljd som anses proportionerlig till brottets allvarlighetsgrad.
