Sammanfattning: The purpose of this research is to examine how the family law secretay’s role is created by other professions regarding custody trials. The research will focus on the experiences of the family law secreties and their participation in custody trials along side of the legal disputes concerning; custody, residence and contact within families. The methods that has been used are; semistructual interviews with the employees of the local authorities in social work, family law. And structural observations regarding the participation of the family law secretaries during the custody trials. The result shows that family law secretaries tend to use more of a legal logic rather than being psychosocial experts in the courtroom. Despite this, the family law secretes are being questioned for being too subjective in their assessments. However, the interviews show that a discretion is necessary to be able to make a professional assessment. In addition, they consequently described themselves as a negotiator as well as the child’s representative. In conclusion, the family law secretaries have trouble fulfilling their role of the negotiator in the courtroom due to the institutional framework.
