Sammanfattning: The thesis is about employee financial participation (EFP) in Swedish company law. It presents an overview of EFP in Swedish law as well as an analysis of a few problems relating to EFP. It also provides comparative outlook on French, German and European law relating EFP. The Swedish part of the study analysis how different kinds of EFP are regulated in Swedish law and mainly in company law. It then discusses a few problems and uses of EFP. It begins with a short history of EFP, mainly, in Sweden. It then looks at some of the underlying interest of EFP, including economic democracy. The aim of the thesis is twofold. First to chart EFP in Swedish law, second: to analysis hindrance and opportunities for EFP in Swedish company law to see what makes EFP attractive or unattractive for Swedish companies and their employees. The thesis focuses on three different problems: 1. Complicated to setup, especially for small to medium size companies (SMEs), 2. The double/dual risk for the employees, 3. The expansion of owners.
