Sammanfattning: The legislator has, during the last decade, tried numerous times to raise the punishment for committed murders without any remarkable success. A new proposition is under review and will probably be voted on. The proposition is to become law in the beginning of 2020. In criminal law there are a few fundamental theories and principles related to legislation. Most fundamental are the principle of proportion – the punishment must be in proportion to the crime committed, and the principle of legality. The purpose of this thesis is to examine whether the new proposition is compatible with these fundamental theories and principles of criminal law and whether the proposition could have been formed in another way in order to better fulfill its, and earlier propositions, purpose and motive. For this, the reader will initially be introduced to the theories and principles of legislation, and to the evolvement of Swedish legislation regarding murder in the last decade. The reader will also be introduced to Norwegian law regarding murder for a comparison on how they have solved their system.
