Sammanfattning: Swedish administrative law has historically shown a lack of compliance with the requirements of access to court in accordance with European law and EU law. Several measures have been taken to address the deficiencies in the right to a court hearing, but in the case of several so-called appeals boards there is still some ambiguity in how well these committees live up to the right to access to court in accordance with European law and EU law. In this essay, the traditional legal dogmatic method is used to examine whether the current regulation regarding appeals from administrative decisions made by Swedish universities, colleges and professional colleges to one of the higher education sector's appeal boards, The Higher Education Appeals Board of Sweden, is compatible with the European law and EU law and obligations Sweden with regard to the right to appeal and a court hearing. The conclusion of the essay is that the prevailing regulation of The Higher Education Appeals Board of Sweden is unlikely to meet some of the requirements for special procedural legal security guarantees as laid down in Article 6 (1) of the ECHR.
