Lika inför lagen? En kvalitativ granskning av LVM-domar utförda av Förvaltningsrätten

Sammanfattning: This study focuses on the fact that women and men often are treated differently in both society and court negotinations. The Care of Alcoholics and Drug users Act (Lag 1988:870 om vård av missbrukare i vissa fall) in certain cases give society a possibility to intervene when a person with addictive problems can’t break the addicition themselves. The main aim of this study is to examine if norms based on gender plays a role when the drug user is taken into compulsory care and if the act is used differently depending on if it is a male or female? The methodological approaches that are used in the study are qualitative. A qualitative content analysis of 32 custody care verdicts from an administrative court in Sweden have been used to see whether women and men are judged and treated equally or if gender makes a difference and in which way the judgement is different? The result of the study shows that there are differences how men and women are described in the sentenceses and treated in court.
