Konsekvenser och åtgärder i byggprojekt till följd av force majeure-händelser

Sammanfattning: This study deals with the impact of force majeure events on construction projects. A force majeure event is an unexpected event which is the reason why a party cannot perform its contracted part. The covid-19 pandemic and the Russia-Ukraine conflict are examples of this. The purpose of the investigation then became to map consequences and identify measures in construction projects as a result of force majeure events. Relevant theory and what is previously known about the subject is examined in a literature study. The method being used in the study is an interview study of these events. The interview study is carried out using semi-structured qualitative interviews. The questions asked in the interviews deal with consequences such as force majeure events that affect construction projects, questions about deliveries, finances, impact on the end customer, work environment and quality investigations. Then questions are asked about the measures taken and which should have been taken. Additionally a smaller case study was also carried out, investigating how a specific project has been affected by force majeure events. The results of the literature study, interview study and the case studyis that the covid-19 pandemic and the Russia-Ukraine conflict have had consequences in all of the surveyed areas. While the results for measures from the interview study included being able to investigate alternative suppliers, trading contracts at fixed price, and also having national warehouses for material and products that don’t develop significantly over time. The conclusions that the study reached were that force majeure events gave rise to consequences such as delivery problems, increased stress levels, postponed schedules, worse working environment and quality of execution. Measures to deal with these consequences then became that a company should have adocumented crisis plan for the force majeure events which should and couldinclude providing extra resources, bringing forward lineups, investigating the possibility of trading contracts at a fixed price, including in contracts what happens in cases of force majeure, to investigate possibilities regarding alternative suppliers and to store nationally.
