   Sammanfattning : This thesis discusses the development of the state’s liability for non-pecuniary damages caused by violations of the basic human rights protected by the European Convention on Human Rights (ECHR). The thesis identifies and critically discusses differences and similarities between the Supreme Court’s case law and the provision 3:4 in the Swedish Tort Law (skadeståndslagen 1972:207), which regulates the state’s liability for violations of the ECHR since the 1st of April 2018.
