Strävan mot den könsneutrala rättvisan - ideal eller verklighet? En kvalitativ studie om könsskillnader enligt rättstillämpningen av 3 § LVU

Sammanfattning: This study aimed to investigate the differences between girls and boys who get sentenced to the Care of Young Persons (Special Provisions) Act in Sweden. We wanted to investigate if there were any differences between why they get sentenced and if the view on gender about social problems differs in the court documents. The method was based on qualitative research to analyze twenty court documents, ten girls and ten boys, applying Judith Butler’s gender theory combined with social norms to acknowledge and discuss the differences in social problems about gender. We were handed the documents from different Swedish courts. Our findings are presented under three main categories based on the Care of Young Persons (Special Provisions) Act. The results of the study show that social problems are presented differently depending on gender, whereas the issues that boys present are easier to distinguish as opposed to girls. Despite this, girls appear to receive help and support earlier and to a greater extent.
